Terms of Service

Last updated November 4, 2026
The short version. We collect what you type into our contact form so we can build your free mockup and get back to you. We do not sell it, rent it or trade it. Ask us to delete it and we delete it.

The short version

You see our work before you pay for it. You can cancel any month. You keep everything we build. The rest of this page spells that out so nobody has to guess later.

Who this is between

These terms are between you, the business owner who hires us, and SwiftEdge Agency, a Fresno, California marketing business run by Jakob Garcia. Using swiftedgeagency.com or hiring us means you agree to them.

What we do

  • Website only. A one time build fee, then a monthly fee that covers hosting, your domain connection, forms, email routing and small changes. We show you a complete mockup first. If you do not approve the mockup, you owe nothing.
  • Lead Engine. A monthly management fee plus your ad spend. It includes a website we build, Google and Meta ad management, automated lead follow up by text, a weekly report and a monthly call.
  • Lead Engine Pro. Lead Engine plus AI search ads, review request and reactivation texts, and additional campaign work, for larger ad budgets.

Current prices are on the pricing section of our home page. The price you are quoted in writing when you sign up is the price you pay, until either of us changes the agreement in writing.

The free mockup and the free two weeks

The website mockup is free. You pay the build fee only after you approve it, and the site goes live within 24 hours of that approval.

On Lead Engine, the first 14 days of management are free. You pay your ad platforms directly for ad spend during that time; we do not charge a management fee. We ask for a card on file when the two weeks start. If you do not cancel by the end of day 14, the first monthly management fee is charged on day 15 and on the same day each month after that.

"Or you don't pay" means exactly that: no management fee is owed for the first two weeks, whatever the results. It is not a guarantee of a specific number of leads, jobs or revenue, and we never promise one.

Ad spend

Ad spend is money you pay to Google, Meta, OpenAI, Microsoft or any other ad platform. It is separate from our fee, it is billed by them to your card, and it is non refundable by us. We recommend a minimum of $1,000 per month in ad spend because below that the platforms do not have enough data to optimize.

Billing

  • Website build fees are due in full on mockup approval, before launch.
  • Monthly fees are charged automatically to the card on file on your billing date.
  • If a payment fails, we will let you know and try again. If it stays unpaid for 10 days, we may pause ads and management until it clears.
  • Prices do not change mid month. If a price changes, we tell you in writing at least 30 days before it applies.

Cancelling

Everything is month to month. Cancel any time by texting or emailing us. We stop billing at the end of the period you have already paid for, and we do not charge cancellation fees.

When you leave, you keep the ad account, the creatives, the landing pages, the tracking data and the website files. If we are hosting your site and you cancel the hosting fee, we will hand you the files and help you move them within 30 days.

What we need from you

  • Accurate information about your business, your license and your services.
  • Access to the accounts we need to do the work, such as your Google Business Profile, ad accounts and domain.
  • Photos, logos and text that you own or have permission to use.
  • Prompt answers when a lead or an ad needs a decision from you.

Lead follow up texts

Lead Engine sends automated texts to people who contact your business, for example a reply within 60 seconds of a form fill or a missed call. These go out under your business name. You are responsible for the messages being truthful and for honoring opt outs, and we build every sequence so the recipient can reply STOP at any time.

Results

We work hard to get you leads, and we show you the numbers every week. Advertising depends on your market, your pricing, your follow up and the platforms, so we cannot and do not guarantee a specific number of leads, calls, jobs, rankings or revenue.

Who owns what

You own your brand, your content, your customer data and your ad accounts. We own our processes, templates and tools. Once you have paid for a website, the finished site is yours.

Limits

Our total responsibility to you under these terms is limited to the fees you paid us in the three months before the issue. We are not responsible for lost profits, platform outages, policy decisions by Google, Meta or other platforms, or anything caused by information you gave us that was wrong.

Disputes

If something goes wrong, text or email us first and we will try to fix it. These terms are governed by California law, and any dispute that cannot be settled between us will be handled in Fresno County, California.

Changes

If we change these terms we update the date at the top and, for active clients, tell you in writing. Continuing to work with us after that means you accept the new terms.
